The Central Bank of Brazil (BACEN) established by Circular No. 3,689 / 2013, with the amendments given by Circular 3,814 / 2016 and Circular 3,822 / 2017, the obligation for all companies that receive direct investment with assets total or shareholders’ equity equal to or greater than R $ 250 million, on the base date of Setember 30, according to the following calendar:
- data base of December 31st, the information should be provided by March, 31st of the subsequent year;
- data base of March 31st, the information should be provided by June, 30th;
- data base of June 30th, the information should be provided until September, 30th; and
- data base of September 30th, the information should be provided by December, 31st.
We also reinforce that the Article 36 of Law No. 13,506/2017 and Circular No. 3,857/2017 of BACEN set forth the possibility fines up to BRL250,000.00 (two hundred and fifty thousand reais), in case of incorrect, incomplete or untimely information.
