If you have assets or investments abroad that totaled US$ 100 million or more on 09/30/2023, you need to submit the Declaration of Brazilian Capital Abroad to the Central Bank (BACEN).
Brazilian Capitals Abroad (CBE) are constituted by the values, goods, rights, and assets of any nature held outside the national territory by residents in Brazil.
The periodic provision of information to the Brazilian Central Bank is a source of data for the compilation of statistics on the country’s foreign sector, such as the Balance of Payments and the International Investment Position.
These capitals must be informed to the Central Bank, annually or quarterly, depending on the classification. The provision of information concerning capital abroad is mandatory for individuals or legal entities resident, domiciled or with head office in the country, which hold, abroad, assets totaling:
- One million US dollars (US$ 1,000,000.00), or equivalent in other currencies, on December 31 of each base year – CBE Annual.
- One hundred million US dollars (US$ 100,000,000.00), or equivalent in other currencies, on March 31, June 30, and September 30 of each base year – CBE Quarterly.
Criteria for imposing a fine
The fines for not providing information concerning capital abroad or in the other cases provided for in the legislation vary from BRL 2,500.00 to BRL 250,000.00 and can be increased by 50% in some cases.
The deadlines to submit the information concerning capital abroad are fixed:
- For the annual submission referring to the base date of December 31 of each year: February 15 to April 5 of the subsequent year;
- For the quarterly submission for the base date of March 31: April 30 to June 5 of the same year;
- For the quarterly submission for the base date of June 30: July 31 to September 5 of the same year; and
- For the quarterly submission as of September 30: October 31 to December 5 of the same year.
